Lecture Lounge is a bi monthly lecture series held somewhere between a bar and a classroom. We host experts and academics covering niche and unexpected topics, where the range is limitless. Our last lecture explored intellectual property, 300 years of copyright law and generative AI.
This lecture focuses on the Dutch youth criminal justice system and how the age at which someone can be treated as a minor or an adult can shift based on neurodevelopment.

Most people, including most Dutch people, assume the law treats you as an adult the moment you turn 18. The Dutch criminal justice system does something more nuanced than that.
Since 2014, the Netherlands has operated under Adolescent Criminal Law, a system built on the premise that developmental age matters more than chronological age. A judge can apply juvenile criminal law to offenders up to 23, or adult criminal law from as young as 16. The deciding factor isn’t a birthday. It’s a professional assessment of how old the brain actually is.
Lotte Baudert
advises on risk and interventions. As a forensic criminologist and probation officer at Fivoor GGZ, she advises prosecutors and judges on risk and on which interventions actually reduce the chance of reoffending.

This lecture unpacks how the system works, the common misunderstandings surrounding it, and the role neuroscience plays in decisions that shape someone’s life. At its core, Dutch criminal justice treats rehabilitation and resocialization as one of the primary goals rather than punishment. Lotte will explore what that means in practice, and why it might invite us to think about justice differently.

Lecture Lounge is een tweemaandelijkse lezingenreeks die ergens tussen een bar en een klaslokaal plaatsvindt. We nodigen experts en academici uit om te vertellen over niche en onverwachte onderwerpen, waarbij het scala aan thema’s eindeloos is. Tijdens onze vorige lezing gingen we in op intellectueel eigendom, 300 jaar auteursrecht en generatieve AI.
Deze lezing gaat over het Nederlandse jeugdstrafrecht en hoe de leeftijd waarop iemand als minderjarige of volwassene kan worden berecht, kan verschuiven op basis van de neurologische ontwikkeling

De meeste mensen, ook de meeste Nederlanders, gaan ervan uit dat de wet je vanaf je 18e als volwassene beschouwt. Het Nederlandse strafrecht werkt echter genuanceerder dan dat.
Sinds 2014 werkt Nederland met het adolescentenstrafrecht, een systeem dat ervan uitgaat dat de ontwikkelingsleeftijd belangrijker kan zijn dan de kalenderleeftijd. Een rechter kan jeugdstrafrecht toepassen op verdachten tot 23 jaar, of juist vanaf 16 jaar het volwassenenstrafrecht toepassen. De doorslaggevende factor is niet je verjaardag, maar een professionele inschatting van de ontwikkelingsleeftijd van je brein.

adviseert over risico’s en interventies. Als forensisch criminoloog en reclasseringswerker bij Fivoor GGZ adviseert zij officieren van justitie en rechters over risico’s en over welke interventies de kans op recidive daadwerkelijk kunnen verkleinen.
Tijdens deze lezing legt Lotte uit hoe het systeem werkt, welke misverstanden er bestaan en welke rol neurowetenschap speelt bij beslissingen die iemands leven kunnen beïnvloeden. Binnen het Nederlandse strafrecht zijn rehabilitatie en resocialisatie belangrijke doelen, naast het opleggen van een straf. Lotte bespreekt wat dit in de praktijk betekent en waarom deze aanpak ons misschien uitnodigt om anders naar recht en rechtvaardigheid te kijken.
